These Terms of Service describe the general project policies of G-Giant Construction Inc. Each project will be governed by a separate written estimate, proposal, or contract approved by the Client and G-Giant Construction Inc.
For residential construction services subject to the Massachusetts Home Improvement Contractor laws, including residential contracting agreements exceeding $1,000, the parties will enter into a written project contract containing the information, provisions, and notices required by applicable law.
If these Terms conflict with a signed project contract or applicable law, the signed project contract and applicable law shall control.
1. Scope of Work
All services will be performed in accordance with the written and approved scope of work for the project. The applicable contract, estimate, or proposal will specify the services, materials, price, payment schedule, and other project conditions.
Work not included in the approved scope will be considered additional work and may require a written Change Order or other written authorization.
2. Changes and Additional Work
Changes, upgrades, or additional work must be approved in writing by the Client and G-Giant Construction Inc. before such work is performed, when applicable.
Concealed or not reasonably identifiable conditions discovered after work begins—including deterioration, rot, structural conditions, conditions behind walls, floors, or ceilings, and technical or code requirements—may affect the scope, price, and project schedule.Any resulting additional work will be documented and authorized in writing as applicable.
3. Deposits and Payments
Deposits, progress payments, and final payment requirements will be established in the individual project contract and will be subject to applicable Massachusetts law.
For projects subject to the Massachusetts Home Improvement Contractor Law, advance deposits will comply with applicable legal limits, including permitted exceptions for special-order or custom materials or equipment.
Final payment will be handled in accordance with the project contract and applicable legal requirements.
4. Permits, Licenses, and Code Compliance
Responsibility for obtaining Building Permits and other permits or authorizations will be determined according to applicable law and the contractual role performed by G-Giant Construction Inc. on each project.
When G-Giant Construction Inc. is the contractor directly hired by the homeowner and Massachusetts law assigns responsibility for obtaining permits to the contractor, G-Giant Construction Inc. will inform the homeowner of the permits required and will obtain those required for the contracted scope of work.
When G-Giant Construction Inc. acts as a subcontractor to another contractor, General Contractor, or Permit Holder, responsibility for the primary Building Permit and general project authorizations will be determined by the prime contract and applicable law. G-Giant Construction Inc. will remain responsible for licenses, registrations, documentation, and authorizations specifically required for its own scope of work.
When applicable under the Massachusetts Home Improvement Contractor Law, homeowners should be aware that obtaining their own Building Permit may affect their eligibility for protections available through the Massachusetts Home Improvement Contractor Guaranty Fund.
No work will knowingly be performed in violation of applicable building codes or legally required authorizations applicable to G-Giant Construction Inc.'s scope of work.
5. Project Schedule and Delays
Project dates and durations are reasonable estimates unless the individual project contract provides otherwise.
The schedule may be reasonably adjusted due to weather, inspections, permits, material availability, concealed conditions, authorized changes, directions from architects or engineers, work performed by other contractors, property access, emergencies, or other circumstances beyond the reasonable control of G-Giant Construction Inc.
Material schedule changes affecting G-Giant Construction Inc.'s scope will be communicated to the Client when reasonably possible.
6. Access and Client Responsibilities
The Client or party responsible for the project shall provide reasonable access to the areas necessary for performance of the contracted scope and to required utilities when applicable.
The Client is responsible for keeping children, pets, vehicles, valuables, and personal belongings away from work areas unless otherwise provided in the project contract.
Known hazardous, unsafe, or unusual conditions at the property must be disclosed before work begins.
7. Workmanship and Material Warranties
Any warranty expressly provided by G-Giant Construction Inc., including its duration, coverage, and exclusions, will be specified in the applicable project contract.
Products and materials may carry separate warranties provided by their respective manufacturers and subject to the manufacturers' terms and procedures.
Temporary repairs, investigative work, structural exposure, and emergency or stabilization services will not carry any warranty beyond what is expressly stated in writing and legally applicable.
Nothing in these Terms limits any consumer right or warranty that cannot legally be waived.
8. Insurance, Existing Conditions, and Third Parties
G-Giant Construction Inc. maintains insurance coverage applicable to its operations. A current Certificate of Insurance (COI) may be provided upon request.
G-Giant Construction Inc. will not be responsible for pre-existing defects, concealed conditions that could not reasonably have been identified before opening or performing the work, or for acts, omissions, designs, calculations, or services performed by third parties, except to the extent otherwise required by applicable law.
9. Cancellation and Termination
Requests for cancellation or termination must be submitted in writing.
Any amounts due or refundable will be determined according to the signed project contract, work actually performed, materials purchased, documented expenses, Change Orders, and applicable law.
Nothing in these Terms limits the Client's statutory cancellation rights. When the Massachusetts Home Improvement Contractor Law requires a three-business-day cancellation period or a specific Notice of Cancellation, those rights and documents will be provided as required by applicable law.
10. Written Project Documents
The agreement applicable to each project may include the signed contract, approved estimate or proposal, Scope of Work, drawings, specifications, payment schedule, Change Orders, notices, and other documents expressly incorporated into the agreement.
Material changes to the scope, price, or contractual obligations must be documented as required by the contract and applicable law.
These website Terms do not replace a written contract when Massachusetts law requires a specific written agreement.
11. Governing Law
These Terms and project contracts for work performed in Massachusetts will be governed by the applicable laws of the Commonwealth of Massachusetts.
Nothing in these Terms is intended to exclude, restrict, or waive any right or protection that cannot legally be excluded or waived.
